1. Terms of Service
1.1 Introduction
These Terms of Service (“Terms”) govern your use of the KidzCubicle website, mobile application, and services (“Services”). KidzCubicle provides safe indoor play areas for children and adults aged 2–60 years in shopping malls across India, along with robotic courses for children aged 6–15 years.
1.2 Definitions
- We/Us/Our/KidzCubicle: KidzCubicle India Pvt Ltd and associated legal entities
- You/Customer: Any person accessing our website, app, or facilities
- Parent/Guardian: Adult responsible for the child during facility use
- Child/Children: Ages 2–17 using facilities
- Adult: Ages 18–60 using facilities
- Play Package: Prepaid play minutes valid for 1 year
- Booking: Optional reservation with no penalty for non-attendance
- Robotic Course: Educational program for ages 6–15
- Account: User profile with registered child/adult profiles and packages
- Purchase Date: Date of payment confirmation
1.3 Acceptance of Terms
By accessing our website, registering an account, purchasing play packages, or using our facilities, you agree to be bound by these Terms. If you do not agree, do not use our Services. We may modify these Terms at any time; continued use constitutes acceptance.
1.4 User Eligibility & Responsibility
1.4.1 Account Registration & Eligibility
- Account registration is mandatory to purchase play packages and use facilities.
- Parents/guardians or authorised adults may register accounts and bring children.
- Adults (18–60) may register individual accounts.
- Account Holder responsibilities: accurate information, credential confidentiality, ensuring child supervision, following facility rules, and medical fitness of users.
- Important: Login credentials are not automatically issued. Access is managed by the account holder during registration or via Google Sign-in.
1.4.2 Profile Management
- Each account must have at least one profile (child or adult).
- Profiles require name, age/DOB, and medical/allergy info; multiple profiles are allowed.
- Age accuracy is critical for safety; profiles can be updated any time.
1.4.3 Supervision Requirements
- Parents/Guardians must remain on the premises during children's visits.
- Staff supervise activities but do not replace parental supervision.
- Typical staff ratio: 1:10 during normal hours; parents are responsible for belongings.
1.4.4 Health & Fitness Requirements
Users with contagious illnesses, certain skin infections, severe unmanaged allergies, recent injuries preventing safe participation, uncontrolled behavioural conditions, or other disqualifying conditions must not participate. You warrant users are fit to participate.
2. Play Packages, Registration & Usage
2.1 Account Registration & Play Package Purchasing
2.1.1 Mandatory Registration Process
- Registration required before any purchase.
- Requires email, password, phone, name, address.
- Add at least one profile (child or adult) during registration.
- Credentials managed by the user or Google Sign-in.
2.1.2 Available Play Packages
- Regular (GST 18%): Trail 20m, Bronze 60m, Silver 130m, Gold 280m, Value 600m.
- Group & Party (GST 18%): Birthday Party (up to 25 kids), Exclusive Play Dates (15+ kids).
- Retail (GST 5%): LEGO kits.
- Pricing available at facilities or on request.
2.1.3 Payment Processing
- Full payment at purchase via card/UPI/net banking.
- Processed by Razorpay (PCI DSS).
- Success email sent immediately; failures cancel transaction.
- GST: 18% on services; 5% on retail LEGO.
2.1.4 Account & Package Ownership
- Packages are non-transferable between accounts.
- Play minutes usable by any profile under the same account.
- Disputes resolved by KidzCubicle management.
2.2 Play Package Usage & Expiration
2.2.1 Using Play Time Minutes
- Minutes deducted by visit duration; partial minutes rounded up.
- Remaining balance visible in dashboard.
2.2.2 Package Validity & Expiration
- Valid 1 year from purchase; unused minutes are forfeited after expiry.
- No extensions or exceptions.
2.2.3 On-Site Usage
- You must have sufficient minutes; otherwise purchase more or visit for a shorter duration.
- Staff verify balance at check-in.
2.3 Optional Booking Feature
- Booking optional; first-come first-served is allowed.
- Email confirmation shows slot and location; capacity limits apply.
- No penalties for missed bookings; minutes remain intact.
- Modify/cancel anytime via website dashboard.
3. Birthday Party & Exclusive Play Dates Packages
3.1 Birthday Party Package Overview
- Slot: 2 hours total, includes ~30 min prep/cleanup; ~90 min playtime.
- Up to 25 kids; extra charges beyond 25.
- Includes themed areas, staff facilitation; optional photos/goodie bags/decor help.
3.2 Exclusive Play Dates Package Overview
- For 15+ kids; ideal for schools, corporate family days, communities.
- 2 hours total incl. setup/cleanup; ~90 min play.
- Includes staff facilitation and zone setup; excludes decorations, gifts, photos, food.
3.3 Rules & Policies
- Pickup/drop by guardian; late pickup may incur charges.
- Prohibited: helium balloons, sparklers, glass, open flames. Small normal candles allowed.
- Facilitators supervise activities; no personal care duties.
- Food allowed; host supplies disposables and handles serving/cleanup within the slot.
- Return gifts allowed (Birthday Parties). KidzCubicle not liable for loss/damage.
- Time is strict; overstays may be charged. Safety rules always apply.
3.4 Unified Cancellation & Refund Policy
- Non-refundable under all circumstances, including no-shows or early end.
- One postponement allowed with 30+ days’ notice, subject to availability.
- Special circumstances (with documentation): death, natural calamity, permanent facility closure. Submit within 30 days; decision in 15 business days; approved refunds in 7–10 business days.
4. LEGO Kits & Retail Products
- Available at facilities; prices include GST (5%).
- Refunds (LEGO only): within 7 days, unopened, original condition with receipt.
- Non-refundable: opened, damaged, missing parts, beyond 7 days, no receipt.
- Verification in 3 business days; refund in 5–7 business days.
5. Robotics Courses
- For ages 6–15; Beginner/Intermediate/Advanced; 8-week terms.
- Separate registration; accurate child profile required; full payment on registration.
- Non-refundable fees; 2 make-up classes per term; no carry-overs.
- Special cases (no cash refund): deferral to next session, transfer to another child, or account credit at KidzCubicle’s discretion with documentation (medical emergency, death in family, relocation).

7. Special Events & Seasonal Activities
- Optional participation; may involve extra registration/fees.
- Events include Halloween, Christmas, Diwali, Children’s Day, regional festivals, and themed events.
- By participation, parents accept inherent risks and authorise basic first aid.
8. Assumption of Risk & Acknowledgment of Terms
- Inherent risks include falls, collisions, minor injuries, allergies, heat stress, and contact with others.
- You release KidzCubicle, mall authorities, vendors, and insurers from claims arising from normal activities and ordinary negligence. KidzCubicle retains liability for gross negligence or statutory breaches.
9. Facility Rules & Code of Conduct
- Respectful conduct; follow safety instructions; no abusive behaviour, intoxicants, or weapons.
- No entry with contagious illness; report accidents and equipment damage immediately.
- Enforcement: warning → denial for visit → 30-day suspension → permanent deactivation for serious breaches.
10. Health & Safety Policy
- Pre-visit declarations on symptoms, infections, allergies, conditions, medication.
- On-site visual health checks; entry denied for visible contagious symptoms.
- Isolation and guardian contact if symptoms arise; pick-up within 30 minutes or directed to medical care.
- Hygiene: hourly disinfection, between-session sanitisation, daily deep clean, professional weekly cleaning, pest control, regular maintenance.
- Emergency: first-aid trained staff on-site; dial 108 for medical emergencies; AED not available.
- Evacuation and incident reporting procedures in place; serious incidents reported within 24 hours.
11. Photography, Videography & Intellectual Property
- Default marketing photography applies unless you opt out via email to dataprotection@kidzcubicle.com with profile names and account reference (effective within 48 hours).
- Parents may take personal photos of their own child only; do not identify other children publicly.
- CCTV in common areas for safety; never in bathrooms/changing areas.
- All website and course content is KidzCubicle IP; no reproduction without consent.
12. Limitation of Liability & Indemnification
- Max liability: the amount paid for the specific service, capped at ₹50,000 per incident or ₹100,000 per fiscal year; excludes indirect or punitive damages.
- Not liable for force majeure, third-party acts, mall issues, maintained equipment failure, theft, or delays beyond control.
- Consumer rights under the Consumer Protection Act, 2019 remain intact.
- You agree to indemnify KidzCubicle for breaches, misconduct, or misuse tied to your account.
13. Dispute Resolution & Grievance Redressal
- Step 1 (48h): customer.services@kidzcubicle.com or +91-9980680197
- Step 2 (10 business days): complaints@kidzcubicle.com
- Step 3 (15 business days): management escalation and final decision.
- Consumers may approach the District Consumer Commission within 2 years; no fee under ₹1 lakh.
- Optional arbitration for disputes over ₹1 lakh per the Arbitration and Conciliation Act, 1996.
14. Statutory Notices & Compliance
- Defects notice: admin@kidzcubicle.com with details; remedy within 15 days.
- GST refunds included when eligible. GST: 18% services; 5% retail LEGO.
- Force majeure: natural disasters, epidemics/pandemics, war, government actions, strikes. Service suspension, credits/deferrals, and possible refunds at KidzCubicle’s discretion.
- Illegal activities strictly prohibited; violations reported to law enforcement.

16. Modifications & Termination
- We may modify Terms; updates posted with “Last Updated” and effective after 30 days; material changes emailed.
- Accounts may be terminated for repeated violations, fraud, dues non-payment, harassment, criminal activity, or child safety violations.
- Service suspension possible for maintenance, security, legal, or safety reasons.
17. Data Protection & Privacy
See the standalone Privacy Policy & Data Protection Statement for comprehensive details. KidzCubicle complies with the DPDP Act 2023, DPDP Rules 2025, Consumer Protection Act 2019, IT Act 2000, and GST laws. Contact the DPO at dataprotection@kidzcubicle.com.
18. Entire Agreement
These Terms, together with the Privacy Policy & Data Protection Statement, Play Package Policy, Birthday Party & Exclusive Play Dates Policy, Robotics Course Policy, and Refund & Cancellation Policy, constitute the entire agreement between you and KidzCubicle. If any provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will continue in full force.
